Terms of Use — Koji

Welcome to Koji (the “App”). These Terms of Use (“Terms”) govern access to and use of the App and the related services (together, the “Service”).

By downloading, installing, or using Koji, you accept these Terms without reservation. If you do not accept these Terms, you must not use the App.

1. Publisher

2. Purpose

Koji is a personal journal for tracking bloating, transit and, if you choose, your menstrual cycle. In particular, the Service enables you to:

keep morning, meal, and transit journals;

photograph a plate to suggest a dish and tags;

connect symptoms with cycle phases;

receive insights and, in time, an export for a healthcare professional.

3. Important notice — Not a medical service

Koji is a personal journal provided for informational purposes. The Service:

is not a medical device and does not provide diagnosis, treatment, or medical advice;

does not replace a doctor, dietitian, or any other healthcare professional;

may produce automated analyses that can contain inaccuracies;

does not guarantee any specific health outcome.

If you have concerning symptoms, consult a healthcare professional. You remain solely responsible for how you use the information provided.

4. Eligibility and account

The Service is intended for people aged 16 or over.

You are responsible for the accuracy of the information provided and for keeping your login credentials confidential.

You are responsible for any activity carried out through your account.

5. User content and AI

Using certain features involves sending text or photographs of plates.

This content is securely transmitted to our AI providers only for the duration of the processing required.

It is never used to train AI models, nor sold or shared for advertising purposes.

6. User content

You retain all rights to the content you submit to the App (“User Content”).

You grant the Publisher a limited, non-exclusive, and revocable license strictly necessary to provide the Service.

You warrant that you have the necessary rights to the User Content you submit.

7. Subscriptions, free trials, and payments

Koji offers paid features through subscriptions managed by the Apple App Store (and Google Play where applicable), via our paywall provider (Superwall).

Offers: as displayed in the App.

Price: applicable prices are shown in the App before any purchase, in your local currency.

Free trial: if a free trial is offered, it is specified before purchase. Any unused portion of a free trial is lost when you subscribe to a paid plan.

Auto-renewal: subscriptions renew automatically for the same period unless auto-renew is turned off at least 24 hours before the end of the current period.

Billing: the Apple/Google account is charged on purchase confirmation and on each renewal.

Management and cancellation: you can manage or cancel your subscription at any time in your App Store (or Google Play) account settings. Uninstalling the App does not cancel the subscription.

Restore: purchases can be restored via the feature provided in the App.

Refunds: purchases are processed by Apple/Google. Refund requests are subject to their respective terms (for Apple: reportaproblem.apple.com).

8. Acceptable use

You agree not to:

use the Service for illegal, fraudulent purposes, or in a way that infringes third-party rights;

submit unlawful, offensive, or privacy-infringing content;

attempt to bypass security measures, reverse-engineer, decompile, or extract the App’s code;

disrupt the Service or servers, or make unauthorized automated use of it.

The Publisher reserves the right to suspend or terminate access in the event of a breach of these Terms.

9. Intellectual property

The App, its interface, texts, logos, trademarks, and all elements that compose it (excluding User Content) are the exclusive property of the Publisher or its licensors and are protected by intellectual property law.

No license or right is granted other than the right to use the App in accordance with these Terms.

10. Availability and changes to the Service

The Service is provided “as is” and “as available”. The Publisher does not guarantee uninterrupted or error-free availability.

The Publisher may change, suspend, or discontinue all or part of the Service, add or remove features, subject to the rights of current subscribers.

11. Limitation of liability

To the extent permitted by applicable law:

the Publisher shall not be liable for decisions made on the basis of content or insights provided by the Service;

the Publisher is not liable for indirect damages, data loss, or harm resulting from misuse of the Service;

nothing in these Terms excludes liability that cannot legally be excluded (including in cases of fraud or gross negligence).

12. Personal data

The processing of your personal data is described in our Privacy Policy, which forms an integral part of these Terms.

You have rights of access, rectification, erasure, and objection, which you may exercise with the contact indicated in section 1.

13. Termination

You may stop using the Service at any time and delete your account from the App.

Account deletion results in the erasure of your data, without prejudice to any legal retention obligations.

Cancellation of a paid subscription is done via the App Store / Google Play (see section 7).

14. Governing law and disputes

These Terms are governed by French law.

Failing an amicable resolution, any dispute relating to their interpretation or performance shall be submitted to the competent courts, subject to mandatory consumer-protection provisions.

15. Changes to these Terms

The Publisher may amend these Terms at any time. The applicable version is the one in force at the time you use the Service.

In the event of a material change, you will be informed by an appropriate means. Continued use of the App after an update constitutes acceptance of the new Terms.
